Dear Chairman Cruz, Ranking Member Cantwell, and Distinguished Committee Members:

We are parents of children and young people who died or were hurt because social media and AI companies designed products to addict, manipulate, and exploit developing brains. These design decisions allowed them to amass power and wealth, the likes of which the world has never seen, but at a horrific and unacceptable cost.

Our children were hurt by social media addiction, anxiety, eating disorders, sexual exploitation, and self-harm, or died as the result of suicide, fentanyl poisoning, and dangerous challenges. We fight every day to make online products safer so that no other family must suffer the way we have.

Despite the progress we have made in courts and classrooms, Big Tech has never wielded more power and influence than it does right now. Lawmakers take meetings with Meta, while we are told to wait; Meta lobbyists are welcomed, while parents must go it alone; and a recent Politico article claimed that “the White House intervened to try and spare Meta CEO Mark Zuckerberg and Google CEO Sundar Pichai from appearing at an upcoming Senate hearing on their companies’ child safety practices…” in turn for the White House’s support for the James T. Woods Act – a bill named after a young person whose death is alleged to have been caused by Meta.

This is not okay. We implore you to stand strongly against tech companies’ demands for immunity and weak regulation. We ask that your committee pass a bill that has a strong and comprehensive duty of care and that clearly safeguards the rights of states and parents to seek justice in courts of law.

We need a bill focused on protecting America’s kids from social media addiction, anxiety, depression, self-harm, eating disorders, substance abuse disorders, platform pushed and shielded drug sales, suicidality, and sexual exploitation, while explicitly and unequivocably protecting stronger state laws and the rights of families to hold tech companies accountable in court.

This is not a partisan issue. State attorneys general and governors from both sides of the aisle are doing their best to protect kids from tech company abuses. We are republicans and democrats alike—the ties that bind us are our loss, our devastation, our fight to honor our kids, and our unwavering belief that we have the obligation to protect future generations.

While Big Tech worked to stall meaningful congressional action for years, a legal battle was playing out in courts across the country. Thanks to school districts, state attorneys general, and families like ours, evidence has come to light showing how tech companies engineered addiction, made the choice to treat children as commodities and revenue streams, and refused to stop even when they knew that our children were suffering.

• • Snap’s CEO was informed Snapchat had: “penetrated 84% of users between the ages of 10 and 24 … 84% = massive monetization potential.”
  • One Meta employee noted: “Child Safety is explicitly called out as a non-goal in our H2 plans. So if we can do something here, cool. But if we do nothing at all, that’s fine too.”  At the same time, Meta’s internal market strategy concluded: “If we want to win big with teens, we must bring them in as tweens,” “People who joined Facebook at 11 years old have almost 4X the LTR [long term retention] of those who joined as 20 year-olds,” and “The Young Ones are the Best Ones.”
  • A senior Meta executive acknowledged: “The fact we say we don’t allow under-13s on our platforms, yet have no way of enforcing it, is just indefensible.”  In one study, Meta wrote that “Instagram sells itself” to kids “age 11-12,” and Meta employees internally discussed the fact that leadership forbid them from asking questions that could result in accountability:
  • “We can’t give people the ability to say they’re under 13, right?” and
  • “My understanding is that we can’t ask if they’re under 13 because it means we’d have to delete their account.” 
  • YouTube internally acknowledged that its “knowledge of age varies” and that only about 6% of accounts had a verified age, and that identified underage accounts were “generally on the platform for 938 days before detection.”
  • In 2021, TikTok lied to European regulators about whether it could identify and remove children under 13: “After we promised this new U13 model to the regulators, we discovered … that TnS had launched a model for detecting U13 … at the end of 2020.”  When TikTok realized its error, instead of correcting it, it worried that if regulators learned the truth it would be forced “to delete a large volume of u13 [under-13] users.”
  • Meta researchers and engineers made clear that Meta was designing for addiction: “Oh my gosh y’all IG is a drug.” A colleague responded: “We’re basically pushers.” Another agreed: “Seriously it is!… We are causing reward deficit disorder.”  Other Meta documents acknowledged:
    • • “Teens can’t switch off from Instagram even if they want to.”
      •  “Teens are hooked despite how it makes them feel. Instagram is addictive, and time-spend on platform is having a negative impact on mental health.”
      •  “Are there teens that use too much Instagram? It sure looks like it…. It seems relatively clear that younger people are less equipped to handle social media addictions…. In the US alone, there are 550K+ teens that spend 28 hours a week on Instagram (4 hours a day, 7 days).”
      • “The Facebook Family of Apps are responsible for problematic use—without these platforms problematic use would not exist.”
      • “[S]ocial media addiction: heavy usage of Facebook correlates with lower happiness.”
  • In 2016, YouTube wrote, “We aspire to create an app that is … Addictive …” and, in 2018, YouTube wrote, “if DSM criteria were applied to watching gaming videos [on YouTube], 1 in 5 teens would be diagnosed with addiction.”
  • A TikTok employee wrote that TikTok “utilizes many coercive design tactics that detract from user agency such as infinite scroll, constant notifications, and the ‘slot machine’ effect.” 
  • Meta determined that it was “recommending nearly 4x as many minors to groomers (nearly 2 million minors in the last three months)” and that “22% of those recommendations resulted in a follow request.”  In a different memo, it admitted that it was not de-platforming adult Messenger accounts engaged in Inappropriate Interactions with Children (IIC): “Messenger does not de-platform flagged adult accounts.” 
  • Meta employees acknowledged: “Thousands of minors have been reporting IIC T1 abuse… we haven’t done anything.” (IIC T1 is an internal tech safety classification used by Meta for the most serious “inappropriate interactions with children” such as sex trafficking and suicide.) The same employee warned: “We had a broken escalation path and no measurement. God knows what happened to those kids.”
  •  Snapchat purported to provide reporting mechanisms for users experiencing in-app harms – like sexual abuse, while its own documents made clear that it was letting most of that media expire before it reviewed the reported harms: 46% of 6,063,523 “Sexual Content” reports made by users, and an incredible 86.3% of 2,459,057 “Sexual Content” detections made by Snap’s own systems.
  • TikTok touted its Family Pairing safety feature, assuring parents that they could monitor their children on the platform.  But internally, employees admitted that there was a “hidden” unlink option kids could use to unpair from their parent, without the parent ever knowing.  As one TikTok employee pointed out, “this renders the feature kinda useless.”

Unless and until tech companies are legally required to put children’s safety ahead of their bottom lines, just like every other business in the U.S., families and communities will keep paying the price.  We ask the Committee to stand with families, schools, and states against Big Tech’s demands to enact meaningful reforms that will impose strong duties of care and will not threaten the ability of states, attorneys general, school districts, and American families from pursuing justice in court.
